At Court No.2 in the Kenema Judiciary, the Kenema resident magistrate has committed to the High Court for trial two accuse persons for allaged murder of Mohamed Juldeh Jalloh in Kenema. The accused persons were charged with two counts charges .
Count one; conspiracy contrary to Law. According to the particular of offence, Fatima Sow and Abdul Rahaman Jalloh on Saturday 17th August 2024 at New England Nyadeyama Section in Kenema in the Kenema Judicial District in the Eastern Province of the Republic of Sierra Leone Conspired together with other persons unknown to commit a felony.
Count two; murder contrary to Law. According to the particular of offence , Abdul Rahaman Jalloh on Saturday 17th August 2024 at New England Nyadeyama Section in Kenema, in the Kenema Judicial District in the Eastern Province of the Republic of Sierra Leone Murdered Mohamed Juldeh Jalloh.
In their first appearances before Magistrate Mustapha Braima Jah on 17th September 2024 for preliminary investigation.
Police prosecutor Sulaiman Kamara Esq opened their case and led two prosecuting witnesses (fatural) on the 17th September, 2024. Who testified before the court and were cross examined, the matter was adjourned to the 18th September 2024. The prosecution also produced a former witness on the 18th September 2024 who was the investigating officer who produced and tendeed three evidences before the court.
Both Defence counsels for the accused persons cross examined PW3 and the prosecution closed their case whilst the defence Counsels Monya Sherrif and Victor S.S Ansumana opend theirs and led witnesses.
The matter was adjourned to the 19th of September 2024 for ruling.
After his preliminary investigation having properly listened to all the witnesses from both parties and looked at the evidence before him, this was the ruling of His Lordship Magistrate Mustapha Braima Jah.
According to him, he assatained that the deceased was actually killed. He noted that the evidence from the prosecution was very clear. He refers to the cause of the death certificate tendered before him in evidence as Exhibit ‘B’.
Having regard to the prosecution evidence in its entirety, he reiterated that the prosecution has established sufficient evidence to put the 1st and 2nd accused persons on trial and therefore committed them to stand trial at the High Court.
According to Magistrate Braima Jah “I have looked through the evidence before the Court and I am convinced and satisfied that the accused persons have pleaded guilty to the offences as charged” therefore he stated “I am committing the matter to the Kenema High Court with no bail granted to the accused persons.”
Magistrate Jah ordered that the exhibits be tendered at the High Court the motor bike and mobile phone retrieved at the crime scene be given to the family of the deceased.
This case was presided by his Lordship Magistrate Jah in just three days.
